General Terms
Art. 1: OBJECT
The general conditions define the rights and contractual obligations of the seller and its customers, as well as the conditions applicable to all purchases made through the seller’s website, whether the customer is a professional or a consumer.
Every customer is deemed to have read the terms and conditions and declares to accept them without reservation. Therefore, any order is subject to these terms of sale, to the exclusion of all other general conditions.
The seller reserves the right to modify the terms and conditions at any time. In this case, the applicable conditions are those in effect on the date of the customer’s order.
Art. 2: Products
The proposed products, including food platters (aperitif, brunch, snack, tea-time, etc.) and beverages, are listed in the catalog published on the seller’s website, accompanied by a description.
They are offered subject to availability. If some products are unavailable, the seller will inform the customer as soon as possible and offer them the opportunity to cancel their order without charge or to wait for availability.
Art. 3: Prices
The prices of products are displayed on the site in euros, VAT (10%) included and excluding delivery costs.
The seller reserves the right to change prices at any time.
The applicable prices are those in effect at the time of order confirmation.
Art. 4: Payments
Payments are made via MONEI, Bizum, Paypal, Visa, and Mastercard.
Ownership of the sold product passes to the customer only after full payment of the amounts due.
In the meantime, the customer is responsible for safekeeping and cannot alienate or transform the product.
Art. 5: Territory
Sauge.es sells its products only in the Costa del Sol, Spain.
Art. 6: Order
The customer who places an order fills out an identification form containing all the requested details.
After verification, confirmation, and payment of the order, the customer receives a confirmation email with the order number.
Confirmation of the order implies acceptance of these terms and conditions.
Art. 7: Delivery
Deliveries are made only to the address provided on the identification form filled out by the customer and are limited to the Costa del Sol.
The delivery of the food platters will be carried out by Sauge’s designated delivery personnel. During the order process on the website, the customer will select their preferred delivery date and a time slot proposed by Sauge.
The product always travels at the customer’s risk, who becomes the owner as soon as they receive the order.
Any claims must be made by registered mail sent to the seller’s office within 48 hours of receiving the product; otherwise, they will be excluded.
Shipping costs are calculated based on the destination, size, and weight of the product.
Delivery times are for illustrative purposes only and do not constitute a firm commitment on the part of the seller. Failure to meet these deadlines does not allow the customer to avoid their obligations, to request the termination of the contract, or to claim damages.
Art. 8: Withdrawal / Return
Given that the products offered are perishable food items, it is not possible to return products once the order has been received. Once the consumer has confirmed receipt of their order of appetizer platters, the product is neither refundable nor exchangeable.
Art. 9: Guarantee
The seller is responsible to the customer for any lack of conformity that exists upon delivery of the product used for non-business purposes and that appears within two years of delivery, in accordance with Articles 1649 bis of the Civil Code.
Art. 10: Responsibility
The seller is bound, in the context of online sales, to an obligation of means.
Their liability cannot be engaged for damages resulting from the use of the Internet, including, but not limited to, service disruptions, data loss, viruses, etc.
All data and links included on the website are provided in good faith.
Force majeure releases the seller from any responsibility under the contract and from any compensation.
Art. 11: Intellectual Property
All elements of the seller’s website are and remain their exclusive intellectual property.
Any reproduction, copying, redistribution, modification, or use of parts of the site, whether software, visual, or sound, is strictly prohibited without the prior written consent of the seller.
Art. 12: Protection of Personal Data
All personal data required to process an order is retained by the seller and may be transmitted to companies with which the seller collaborates, when such communication is necessary for processing the order.
The customer agrees to receive offers from the seller and/or its partners.
Personal data is stored to facilitate future orders.
For the rest, the seller agrees not to disclose the available information to any other company.
At any time, the customer can request the seller to correct their data.
Art. 13: Litigation
These general conditions are governed by Spanish law. In case of dispute, the competent courts are those of the judicial district of Malaga.
